TERMS AND CONDITIONS FOR THE TOURLINK eSIM WEB STORE

These Terms and Conditions ("Terms") form a legally binding agreement between you and OMAX GROUP LTD ("OMAX", "we", "us"), the operator of the Tourlink eSIM web store located at tourlink.me (the "Website" or "Store"). By accessing or using the Store, you acknowledge that you have read, understood and agree to be bound by these Terms.

1. Introduction

Tourlink is an OMAX product that enables consumers and organisations to purchase, download and manage electronic SIM ("eSIM") data packages for compatible devices. All connectivity is supplied by OMAX using networks of third party mobile carriers.

2. Definitions

  • Account – the user profile created on the Store through which the Service is purchased and managed.
  • Device – an unlocked, eSIM capable smartphone, tablet, laptop or other equipment owned or controlled by you.
  • eSIM – a digital SIM profile that can be downloaded to a Device and provisioned with a data plan.
  • Service – collectively, the sale, activation, top up and use of Tourlink eSIM data packages and any related customer support services.
  • User / you / your – the natural person or legal entity entering into these Terms with OMAX.

3. Acceptance of Terms

By clicking "I Agree", purchasing a package, or otherwise using the Service you accept these Terms on your own behalf or, if applicable, on behalf of the organisation you represent. If you do not agree, do not use the Service.

4. Eligibility

You must be 18 years or older, or have verifiable parental consent, and have the legal capacity to enter into contracts. You confirm that your use of the Service does not violate any applicable export control or sanctions laws.

5. Services Provided

Tourlink provides prepaid mobile data connectivity via eSIM profiles for use in supported countries. The Store lists available packages, their data allowances and validity periods. Unused data expires at the end of the validity period and is non refundable.

6. Account Registration & Security

You agree to provide accurate information when creating an Account, keep your credentials confidential and notify [email protected] immediately of any unauthorised use. You are responsible for all activity under your Account.

7. Pricing, Payments, Refunds

7.1 Prices & Taxes

Prices are shown in EUR exclusive of taxes unless indicated. Local VAT or GST may apply at checkout.

7.2 Payment

Payment is due in full at the time of order via the methods offered at checkout. Card data is processed securely by third party processors; OMAX does not store full card details.

7.3 Cooling off

If you are an EEA or UK consumer you may cancel within 14 days of purchase provided the eSIM has not been downloaded or activated. Once the profile is delivered or used, the right to withdraw is lost.

7.4 Refunds

Refunds are granted only if (a) you exercise the cooling off right above, or (b) the package cannot be delivered or is unusable due to an error attributable to OMAX. Approved refunds are processed to the original payment method within 14 days.

7.5 Top Ups

Additional data may be purchased through the dashboard. Top Up transactions are final and non refundable once applied.

8. Prohibited Use

You must not:

  • (a) use the Service for unlawful, fraudulent, harassing or abusive purposes;
  • (b) resell or commercialise the Service without OMAX's written consent;
  • (c) interfere with network integrity, reverse engineer or tamper with any eSIM profile or the Store;
  • (d) distribute malware, spam, phishing or other harmful content.

9. Intellectual Property

All trademarks, software and content associated with the Store and Service belong to OMAX or its licensors. No intellectual property rights are transferred to you.

10. Privacy

Personal data is processed in accordance with the Tourlink Privacy Policy. By using the Service you consent to such processing, including international data transfers as necessary to provide global connectivity.

11. Disclaimer & Limitation of Liability

The Service is provided "as is" and "as available." OMAX disclaims all implied warranties, including merchantability and fitness for a particular purpose. To the fullest extent permitted by law, OMAX's total liability arising out of the Service shall not exceed the amount you paid for the affected package. Nothing in these Terms limits liability for death, personal injury or fraud.

12. Indemnity

You agree to indemnify and hold harmless OMAX, its affiliates and personnel against claims arising from your breach of these Terms or misuse of the Service.

13. Suspension & Termination

OMAX may suspend or terminate the Service without notice if you breach these Terms, use the Service unlawfully, or as required by law or regulators. Any remaining data balance is forfeited on termination.

14. Modifications

We may update these Terms or the Service for legal, technical or business reasons. Changes will be posted on the Website with a new Effective Date. Continued use after the effective date constitutes acceptance.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of London, except that EEA consumers may bring proceedings in their home jurisdiction.
